Any major, healthy person of spirit, and
which is not under the blow of a measurement of supervision, can write her
will.
A minor, of more than sixteen years, can also write a will, under certain
conditions, and on a part only of his goods.
The choice of the shape of the will depends on the will of the testator, and,
certain times, of the circumstances.
I - The holographic will
The holographic will is simple, and not
very expensive.
You must entirely write it, of your hand, i.e. which it can be only handwritten
(ever struck with the typewriter). It must be dated, day, month, year, and
be signed, under penalty of nullity, also in a handwritten way.
It does not matter the support: it can be a sheet, a chart, an envelope, or
any other support on which you can write. The drafting must be sufficiently
precise, so that your will appears clearly.
Caution: do not modify your writing for the circumstance, avoid any overload,
erases, joining or spot which would be likely to make it contestable.
It is interdict to make the will of two different people on the same document.
The advantage of the holographic will, it is
its simplicity, its exemption from payment and its discretion. You can as
often as remake it you wish it. You can preserve it on your premise, or to
give it to a person of confidence.
* The eye of the notary
:
Park with the fraud : after your death, your will can not be found, to disappear,
destroyed by a heir who would have found it and who would not be quoted in
the will. It can also be disputed in justice by the heirs.
You can choose to deposit your will in your notary, who will make it record,
at a low cost, with the Central Data Base of the Provisions of Last Wills.
All the wills recorded by the French notaries there are deposited and centralized,
and no succession is open without this file not being systematically questioned.
Moreover, your notary will be able usefully to assist you and advise you in
the drafting of your will, or to check conformity with the law of it.
